Affiliate marketers in the Nevada online poker market could be faced with a decision on whether it is really worth continuing to serve local operators if amendments to the state’s gambling legislation go through this year.
SB40, currently in the senate Judiciary Committee, appears to be very broad in its application, and seeks to make it illegal for affiliates to profit from online gambling operators who do not hold a Nevada online poker licence.
Whilst it is already illegal to accept or receive wagers without a Nevada gaming license, SB 40 extends that punitive liability to anyone who “directly or indirectly” financially benefits or is rewarded for promoting any entity offering illegal wagers in the state.
The brief amendment proposes that violations be treated as Class B felonies, carrying between 1 and 6 years imprisonment or a fine of up to $5,000.
